Noisy Murcia nightclub reaches European Court of Human Rights

The European Court of Human Rights has accepted a complaint over a noisy nightclub in Cabo de Palos, and has given the Spanish government until 2nd April for an opinion on the case.

The complaint admitted for consideration by Strasbourg was presented by the lawyer, José Luis Mazón, on behalf of a family who has suffered noise from the club ever since it first opened seven years ago. EFE reports that the family’s complaint was turned down by Spain’s Constitutional Court after a previous ruling from the Murcia High Court of Justice ruled the club’s owners to be acting legally in playing music on their outside terrace.

Their lawyer is understood to have argued in the complaint to the European Court that the entire family is under medical treatment over the noise levels from the club, while the youngest daughter has had to receive psychological treatment for anxiety and insomnia.

Spain has also been asked by Strasbourg for an opinion on whether an amicable solution can be reached between the parties concerned.
