Man told to leave his house for being too noisy

A judge in Cádiz has ordered a man to leave his home for being too noisy. It’s still not quiet at Number 3, Calle Escalzos in Cádiz; for the past few years the owner of a flat on the third floor has decided to play his music or the radio at full volume at whatever time of the day or night.

The judge considered the complaint placed by the neighbours community of owners ‘totally justified’ as it disturbed their right to sleep and rest.

The judge, Pablo Sánchez, has ordered Alberto García to stay away from his home for three years. It comes after several warnings from the Local Police who even, on one occasion, taped up his music system. The City Hall also measured the volume as being above the legal limits.

The sentence ordering the man to leave his own home is not as strange as it may seem. The circumstance is outlined in the article 7.2 of the horizontal property law, but the three year expulsion is the maximum possible. Alberto García is to appeal to the Provincial Court, so his neighbours cannot sleep soundly yet.
