Torremolinos 1996 PGOU Urban Plan not valid
More confusion over real estate legality as a judge has considered the PGOU Urban Plan which has been applied in Torremolinos since 1996 as null. The judge considers that so as the document was never published in the official provincial bulletin, a legal requirement in Spain, and the same oversight which also occurred in Marbella.
It has come to a head now as the owner of a building in the town is challenging the Town Hall over a change of use licence.
Administrative Court Five in Málaga ruled on February 19 that the PGOU Urban Plan in Torremolinos, approved in 1996, is not in fact valid. It ruled that a fine issued by the Town Hall for change of use on Torrehermosa Properties be cancelled. The company had converted the Las Palomas Aparthotel into individual dwellings.
The previous PGOU, published in Málaga in 1983, before even Torremolinos separated from the city, showed the land concerned as residential.
A statement from Torremolinos Town Hall said that they judicial experts are now studying the ruling.
A new PGOU for the town is already provisionally approved, awaiting only the acceptance from the Junta de Andalucía.
